Mongolia's Casino Tender for Zamyn-Uud Free Economic Zone PDF Print E-mail

A tender is announced for selecting strategic investor in the "Zamyn-Uud" free economic zone. In accordance with the Law on Free Zones and the Law on the Legal Status of the "Zamyn-Uud" Free Economic Zone, the Government of Mongolia announces an international open tender of competitive selection (hereinafter referred to as "Tender") for strategic investor interested in investing in building the Recreation and Entertainment complex (including a casino) in "Zamyn-Uud" Free Economic Zone (hereinafter referred to as "Zamyn-Uud" FEZ) under an Investment Agreement and to be given an exclusive right to run casino business and to invest in establishing main infrastructure of the FEZ (electricity supply lines, a clean water supply, disinfecting and effluent treatment plants, roads, railways, telecommunications network and the international airport).

The Evaluation Committee will organize and evaluate the Tender subject to the terms and rules set forth in the Rules of Tender, approved by Government Resolution 313 of 2006. The Authorized Representative of the Evaluation Committee shall be the Governor of the "Zamyn-Uud" FEZ. The planned area for the Recreation and Entertainment complex in "Zamyn-Uud" FEZ is 20 hectares.

SUBMISSION OF APPLICATION/EXPRESSION OF INTEREST

Domestic or international legal entities or consortia with participation thereof that meet the following requirements set forth by the Government, may submit an Application/Expression of Interest to participate in the Tender: 1. experienced in tourism and services, hotels, entertainment and show business management;2. at least 5 (five) years experience in casino business; 3.equity not less than US$ 500.000.000 (five hundred million); 4.sound financial condition and performance record. Following the Tender Announcement, parties expressing interest to participate in the Tender ("Applicant") must submit a formal Application/Expression of Interest both in Mongolian and English languages accompanied by the following documents to the Authorized Representative of the Evaluation Committee: 1. An Application Form;2. A duly executed Confidentiality Agreement signed by the Applicant s Authorized Representative;3. Evidence of payment of a non-refundable Tender Fee of US$ 1.000 (one thousand);4. In case of designating an Authorized Representative, a Power of Attorney executed according to the procedure specified by law;5. Information regarding Applicant s background, including (in case of a consortium, such information would need to be provided for each of the consortium members):- Legal name, address and business profile of the Applicant;- Capability statement evidencing the Applicant s business activities and experience and in tourism, service, hotel (casino), entertainment and show business management;- Documents evidencing foundation and registration of the Applicant company;- Audited year-end financial statements (in case of a public corporation, annual report to shareholders) for the most recent year;- If the Applicant is a joint-stock or a limited liability company, a list of shareholders owning more than five (5) percent of the Applicant s total stock, including the number of shares owned /the list must be certified by the company s authorized official or by an authorized organization/;- In the case of participating as a consortium, signed agreement between the consortium members and evidence of the decision of the governing body of each member to participate in the Tender as a consortium. The Application Form and Confidentiality Agreement are available from "Zamyn-Uud" FEZ website at If the Applicant appoints an Authorized Representative to represent it in the Tender, the representative s authorization must be confirmed by a written power of attorney executed according to the procedure specified by law. If several legal entities and individuals are participating in the Tender as a consortium, they shall appoint only one Authorized Representative to represent them collectively as one Tender Participant. The Applicant shall be entirely liable for completeness and accuracy of its profile, information regarding its legal status, capital, financial condition and other information submitted to the Tender. Applications/Expressions of Interest to participate in the Tender must be submitted to the Authorized Representative of the Evaluation Committee no later than 18.00 /Ulaanbaatar time/ of March 2, 2007 starting from the date of this Announcement.
